Partner Visas
Whether you apply for a partner visa onshore in Australia or from overseas will largely depend on your individual circumstances and your future goals. As a general rule you will need to show that you have lived together for an extended period, however there are ways around this requirement. If you are in Australia when you apply for this visa you can remain onshore until it is decided. If you are overseas, we can advise you on how to spend time together without jeopardising your partner visa application while you wait for an outcome.
Processing times vary widely, but we generally see them come through in 6-18 months. With a strong application guided by our experience, your chances of a faster decision are significantly improved.
Prospective Marriage Visa
If you are not in Australia and you have not spent sufficient time living with your loved one to qualify for a partner visa, you can consider the Prospective Marriage Visa as it does not require you to have lived together. This is a visa for couples who intend to be married. It will allow you to travel to Australia for a period of nine months starting from the day the visa is granted. If you marry your loved one within that period, you are eligible to apply for the partner visa for a reduced fee. You can then remain onshore and work while you await your visa decision. You must have evidence of meeting at least once in person in order to qualify for this visa.
New Zealand Family Relationship Visa
You can apply for a partner visa if you are in a relationship with an Australian or an eligible New Zealand citizen and your loved one is willing to sponsor you. A partner visa will allow you to live and work in Australia. It also provides a pathway to permanent residence and citizenship.
If you are a family member or partner of a New Zealand citizen, you may qualify for a five-year visa to remain in Australia with your partner/family member. This can easily be renewed each five years. If your partner earns enough income over a number of years you both may become eligible to apply for permanent residence under the New Zealand stream of the Skilled Independent (Subclass 189) visa.

There are several parent visa options to choose from, and the right one for you will depend on a number of factors, including your family composition and location and your age, financial resources, and life goals. Some parent visas are temporary, allowing you to spend a few years supporting your children and their young family. Others provide a pathway to permanent residence and citizenship, which come with the added benefit of access to the Australian healthcare system.
Some parent visas will never be granted in your lifetime. If you apply for one of these whilst in Australia, you will effectively be able to stay for the rest of your life on a bridging visa, but you will never become a permanent resident or be eligible for Medicare, and you will need to pay for health insurance for the duration of your lifetime. This can sometimes be more expensive in the long term than applying for the contributory parent visas, which come with a large price tag – over forty thousand Australian dollars. A contributory parent visa takes five to six years to process, but it is a permanent residence visa with a pathway to citizenship and once granted you would be eligible to access the Australian healthcare system.

There are several child visa options to choose from, and the right one for you will depend on a number of factors, including your child’s location and age and your particular family circumstances.
There are three types of permanent child visa classes, the child visas, the adoption visa, and the orphan relative visa. There is one temporary dependent child visa for temporary partner visa holders seeking to add their children to a future permanent partner visa application.
As a general rule, the child must be under eighteen or under twenty-five and a full-time student dependent on the sponsoring parent for food, clothing and shelter. Children older than 18 who are unable to work due to disability can also be included. Additional evidence will always be required when a child is over eighteen.
All children are required to meet the health requirement which calculates the cost of any health conditions they may have to the Australian community. Children from sixteen years must also provide police clearances and meet the character requirement. It is important to seek professional help where there are any doubts about the child meeting these criteria. Additionally, the dependent child must never have been married or had a de facto partner. However, if the dependent child has their own child, that child may be included in most of the child visa types.
The immigration department scrutinises child visa applications very carefully to protect children from trafficking, so if the child is not migrating with both their biological parents as listed on their birth certificate, you should be prepared to provide evidence of custody and/or the other parent’s consent when seeking to bring children into Australia.
